Terms of Use

1. Use

Skillswap, which may hereafter be referred to as "we", "us", or "this site" holds that use is limited to behavior defined within these terms for you, the user. You agree that you are at least 18 years of age and are not under the age of majority in your country, state or municipality. This is to help protect minors from views they may be uncomfortable with.

2. Conduct

You agree not to post, email, or otherwise make available a post or comment:

a) that is unlawful or threatening, abusive or harassing, invasive of anyone's privacy, or anything that is harmful to minors;

b) that is illegal;

c) that harasses, intimidates or is (in any way) hateful toward an individual or group of individuals on the basis of their gender, sexual orientation, religion, race, ethnicity, age, or disability;

d) that makes it seem as though you're an administrater and/or moderator for SkillSwap;

e) that includes claiming to be someone you are not;

f) that violates a copyright or patent;

g) that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;

h) that contains malicious software or viruses;

Additionally, you agree not to:

i) threaten anyone, or be a nuisance to other users;

j) "stalk" anyone or collect information about them in a creepy fashion;

k) use software to download data from SkillSwap;

3. Risks of Use

As any other community website that has the chance of gaining new members, SkillSwap may one day run the risk of having misbehaved users on it. You must agree not to take any legal action against SkillSwap should you run into any of them. Though rest assured, we'll be fighting with you to eliminate them and ban them from the site forever. Just use common sense and don't talk to anyone that sounds sketchy in any way.

4. Our Rights to Ban People

We reserve the right to ban anyone from SkillSwap at any time, for any reason. For users, this may mean deleting your account. Normally, we will almost never do this -- so it shouldn't happen very often at all.

5. Privacy

Anything uploaded or posted to SkillSwap is done so with the implication that SkillSwap will not be held liable for hosting this content. For a much more detailed account of SkillSwap and your privacy, please view our Privacy Policy.

6. Legal Disputes

You, the user, agree that any disputes will be governed by the laws of Ontario, Canada - and the jurisdiction of any Court will be in Kitchener, Ontario, Canada.

SkillSwap claims immunity from liability to the fullest extent under the law and as provided under the Communications Decency Act for Content provided by third parties and members and nothing in this agreement is intended to waive, remove, or usurp such immunity. You understand and agree that SkillSwap may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment SkillSwap violates the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of SkillSwap and/or its members.
You agree to indemnify and hold SkillSwap, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

7. Commercial Use of SkillSwap

Any users posting ads pertaining to commercial gains will be subject to banning from the site, as well as having their previous posts deleted. SkillSwap is primarily an outlet for private individuals. Attempts to mix commercial posts in with all others will not be tolerated. The sole commercial presence on SkillSwap is offered within its Preferred Professionals pages, in which SkillSwap has previously spoken with a representative from each organization prior to placement therein.
